In certain instances these terms incorporate statements to be found in the Security & Privacy, Payment, Returns & Refunds as well as the Delivery sections of our site. In all circumstances you the customer are responsible for making sure all items will fit in your property before purchase, sizes are found in the product descriptions and specifications tabs.1. Waiver
Every effort has, is and will be taken to ensure that the information contained in this site is correct and up to date. The information may, however, become incomplete, inaccurate or out of date. To the full extent permitted by law, but subject to the terms and conditions of sale referred to below, we are not responsible for any financial loss and can not be responsible or liable for compensation claims due to the accuracy of any information contained on this Site.2. Definitions
For the purposes of these Terms and Conditions the following definitions apply:
Sale. The receipt for sale by us and purchase of Goods by you.
Goods. The range of products which are available for purchase from this site in accordance with the terms.

You may view or print individual pages only for your own personal use. Bed Factory Direct may suspend, alter, restrict or terminate at any time access to or use of this Site.4. Limitation of liability
a: Bed Factory Direct shall not be liable for any damage or loss that may occur in the use of any of the information contained or advice given in this site except as to the extent that such liability cannot be excluded by law.
b: Bed Factory Direct is not responsible for the Site's accuracy when suppliers have changed product specifications, product packaging or other product information.
c: Bed Factory Direct is not responsible for the reliability of the access to this site when access is affected by our third party host or your Internet Provider.
d: Bed Factory Direct is not liable for any damages or losses resulting from your use of or inability to use this Site.
e: Bed Factory Direct will not be liable for any compensation to you for delay due to any causes beyond the reasonable control of Bed Factory Direct or its suppliers, including, but not limited to, delays caused by suppliers (lack of stock, delayed dispatch), delays caused by third party couriers, delays caused by traffic, delays caused by mechanical breakdown, acts of god, civil commotion, industrial disputes, riots, floods, and legislation.
f: Bed Factory Direct can not be held responsible if you book a third party to build your items before receipt of your delivery.
g: Bed Factory Direct can not be held responsible if you book a third party to build your items and they damage them.
h: Bed Factory Direct or our Suppliers can not be held responsible if you modify your goods or try to repair your items before allowing us the opportunity to help you.
i: Bed Factory Direct can not be held responsible for any damage caused to your property by third party couriers.
j: Bed Factory Direct can not be held responsible if you the customer chooses to dispose of any bed, mattress or product before receipt of your delivery.
k: Bed Factory Direct can not be held responsible for items not fitting in your property.5. Content and advertisements
This Site also contains links to other sites which are not under the control of and are not maintained by Bed Factory Direct. These links are provided for your convenience only and Bed Factory Direct is not responsible for the content or availability of those sites.6. Data protection and privacy
All prices quoted are in British pounds (£) and include Value Added Tax (VAT). If the price goes up or down in between you placing and receiving your order, we will honor the original price paid at the time of the sale.8. Ordering, stock availability and products.
8.1: We aim to display only items that are in stock in our warehouse, available for immediate manufacture in our factory and/or are available for direct despatch from our suppliers. From time to time we may sell out of some lines, run low on materials needed to manufacture an item or our supplier might run out of stock for direct despatch in which case we will aim to advise you the same day we are notified of this. In the case of an item being a direct despatch item from our supplier, we are sometimes not notified of an item being unavailable until the day of despatch which can sometimes be the day before delivery. In all cases, you will be given the opportunity to order an alternative or receive a full refund for the full price you paid. In all cases as per section (4) Bed Factory Direct are not liable for any forms of compensation due to this.
8.2: Your order confirmation email is only an acknowledgement of your order and not an acceptance amounting to a contract. Products sold on bedfactorydirect.co.uk are for use in a domestic setting. If you wish to purchase items for commercial use please contact Bed Factory Contracts on 0800 917 6518 to discuss your product needs. Bed Factory Direct can not be held responsible if you purchase domestic products for commercial use.
8.3: Please note that the vast majority of the products on bedfactorydirect.co.uk are flat packed, so some assembly will be required, all Bed Factory Direct divans come in at least one part and you are responsible for making sure they fit in your property.8.4: You should be aware that:
a - all bed and mattress sizes given are UK standard sizes;
b - mattress, base and frame sizes may vary slightly from their stated dimensions due to manufacturing tolerances;
c - mattress comfort/hardness grading is for guidance only and will vary depending on your build and personal preference.
d - When placing a mattress on a bedstead please note that there may be a gap around the edges; this is to allow for rotation & bedding.
e - we are not able to offer a trial or try and buy service.
f - All images on Our website are for illustration purposes only. Unless clearly stated on the website, headboards will not normally be included with a divan bed. If a headboard is required this will need to be selected as a separate item on your order.
g - It is often the case with new mattresses that they will require a 'bedding in' period of 8 to 12 weeks to allow the fillings to settle and the mattress to gently expand to the correct size. Additionally, on occasion new mattresses may carry an odour for up to 10 to 14 days. This may be due to the fire retardant, a legal requirement, and the newness of materials. This odour will gradually dissipate with airing.
h - All roll up mattresses are vacuum packed. Due to this these mattresses can take 3 to 4 days to fully expand.
i - You, the customer, are responsible for checking all items will fit before ordering.
j - All mattress images on our website can be subject to slight fabric changes due to international supply chain issues.9. Delivery
9.1: Delivery can only be made to the delivery address specified on the Order.
9.2: Delivery can be an all day call on your prefered delivery date unless advised otherwise by our despatch department. You are responsible for making sure someone is available to accept the delivery
9.3: During the order process you can select a preferred delivery date. This is your preferred date of delivery, delivery dates and delivery times are given in good faith but are subject to change. Please note we will do everything to meet you preferred date but this is not a guaranteed delivery date for your order. Once goods have been despatched the courier will contact you to arrange a delivery date and estimated time slot. As per section (4) we can not be held responsible for circumstances beyond our control and delays caused by third party couriers. Please allow extra time in difficult to reach postcodes, especially the Scottish Highlands and the Isle of Man.
9.4: Delivery will be deemed to have taken place when the Goods have been delivered to the address set out in the Order. We do not have the ability to satisfy Ourselves that the person accepting delivery at the agreed address is authorised by you to accept the Goods.
9.5: If no one is available to take delivery at the address given by you, you may be subject to a charge for re-delivery of £15 to £60 depending on location. If you choose to cancel your order after delivery we will refund less the original delivery charge.
9.6: If delivery can not be completed due to the Goods not fitting in your property, in these circumstances you may order a different product as a replacement for the Goods:
a - You must pay the difference between the price of the Goods and any replacement product which is of higher value;
b - You must pay a redelivery charge of £30 to £50 depending on your postcode location.
c - If you wish to cancel and receive a refund, we will refund less a £30 delivery restock charge.
9.7: If We are not able to deliver the whole of the Order at one time due to operational reasons or shortage of stock, We will deliver the Order in installments. We will not charge you extra delivery costs for this.
9.8: The Goods will be your responsibility from the completion of delivery
9.9: You must be a suitable adult over 18 years of age to check and sign for the goods.
9.10: You are responsible for checking the delivery and signing for the goods as received in good condition or received as damaged (not doing this can affect the ordering of replacements or refunds if damaged). Goods will be considered as received in good condition unless signed for as damaged on delivery sheets.
9.11: In the unfortunate event of missing parts, these need to be reported to us by email to email@example.com, within 14 days of delivery. When beds are items from suppliers we will request the parts from our supplier as we do not have spares for these beds. In these circumstances we are not able to offer compensation as we do not open the boxes to inspect items and can not be held responsible for errors from third party companies.
9.12: Goods will be considered as accepted when you have signed for delivery.10. Cancellation
10.1 This cancellation right does not apply in the following cases:
a - Any bespoke products made to your special specifications or clearly personalised. This includes bespoke items made to custom sizes and heights. It is Your responsibility to check the measurements provided to us are correct. These are not returnable or refundable unless damaged.
b - In the case of mattresses, bedding and bed linen, if the packaging has been opened, for reasons of health and hygiene these items by their nature cannot be returned unless faulty. Please note that we cannot accept a return or cancellation once a mattress has been slept on.
0.2 - When purchasing through a website, Under the Consumer Contracts Regulations you have a right to cancel your order if you change your mind. Your right to cancel a Sale starts from the date of confirmation of the Order. If the Goods have already been delivered to you, you have a period of 14(Fourteen) calendar days in which you may cancel, starting from the day you receive the Goods. The Goods must be unopened and unused.
a - To cancel a, you must notify us in writing by email to firstname.lastname@example.org, or write to Us at Bed Factory Direct, Marl Road, Knowsley Industrial Estate, L33 7UH. You may wish to keep a copy of your cancellation notification for your own records.
b - You are responsible to arrange the return of your order at your own cost using your own courier within 14 calendar days from the date of cancellation. You will receive a full refund of the price you paid for the Goods Only. We will process the refund due to you within 14 days your returned order has been received by Us in good condition in original packaging.
10.5 - We refund you on the original method of payment.
0.6 - If you cancel before your order has been despatched we will cancel your order and refund within 24hrs.
10.7 - If you cancel after your order has been despatched we will contact the courier to stop your delivery and will process the refund once confirmation from the courier has been received confirming delivery has been stopped. In some cases delivery can not be stopped, in these cases section 10.2 applies.11. Our Rights To Cancel
Your order will be cancelled automatically if we are recommended to do so by our card processing company. If this occurs we will inform you by email. We will not be able to tell you why the have recommended this as we are not privileged to that information. Any monies set aside by your bank as pending will be returned to you by your bank. This can take up to 7 days and Bed Factory Direct will not have received this payment and can not control how long this will take with your bank.12. If the goods are faulty
12.1 - As a consumer, you have rights in relation to Goods that are faulty under the Consumer Rights Act.
12.2 - To help us ascertain the nature of the fault we may ask you to provide evidence to us in the form of images as quickly as possible within 14 days of delivery, they can be either sent to Us using the form in our FAQ pages, emailed to email@example.com or by post to our address. Failure to provide this evidence may prevent Us from progressing the issue.
12.3 - An inspection might be needed. In this case we will contact you to let you know when this will be done.
12.4 - If you report a fault within 30 days of delivery Under the Consumer Rights Act, you have an early right to reject goods that are of unsatisfactory quality or not as described, and get a full refund.
12.5 - If you have rejected the delivery due to the goods being faulty or the packaging damaged, you are entitled to reject the goods at the time of delivery and claim a full refund or replacement. Please let us know by email to firstname.lastname@example.org and as soon as we have confirmed with the courier that you have rejected the delivery and it is being returned to us we will process the refund or replacement within 14 days.
12.5 - In the case of a replacement being offered this will be of equivalent quality or better than the original product purchased from the manufacturer's current range up to the value of what you have already paid or greater if you pay the difference.
12.6 - If you report the fault outside the 30 days of delivery, we have an opportunity to repair or replace any faulty goods before offering a full refund.
12.7 - If you report the fault after the first 6 months the burden is on you to prove the fault has been there since delivery.13. Warranties
We aim to deliver goods of the highest quality. Unless otherwise stated on our website, the products sold have a warranty of 12 months.14. Changes to the terms
Bed Factory Direct reserves the right to remove, modify or change, without notice, any information on this Site from time to time. Bed Factory Direct may change these terms at any time by posting a notice of the changes on the Site. If you use the Site after Bed Factory Direct has posted the changes you will be bound by the new terms. You should therefore ensure that you read the terms each time you use the Site.15. General
E-mails to you will be sent to the address you specify to us. You must only provide us with a valid e-mail address and it is your responsibility to inform us of any changes to that address.
To the extent that any provision of these terms is found by any court or authority to be invalid, unlawful or unenforceable, that provision will be deemed not to be a part of these terms and will not affect the enforceability of the remainder of these terms, nor will it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.
The headings in these terms are for convenience only and do not affect their interpretation.
These terms supercede any representation made by us or any of our employees or agents.16. Compensation
If compensation is offered for any reason by Bed Factory Direct. This is reviewed on an individual case by case and will never exceed more than a 10% value of the order.17. Statutory rights
These Terms & Conditions do not affect your statutory rights.18. Governing law and jurisdiction
These terms and your use of this Site are governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.19. ‘Love it or Exchange it’ OCTASmart Dormeo 60-Night Comfort Exchange Guarantee
At Bed Factory Direct, a great night’s sleep is as important for us as it is for you. If you are not 100% happy with your Dormeo OCTASmart mattress, you may exchange it for one of a different comfort specification from the OCTAsmart range. Information on how the Comfort Exchange works:
A mattress protector must have been used for the duration of the trial period and the original mattress is to be returned in a clean and presentable condition
Notification to exchange the mattress must be made to Bed Factory Direct via an email to email@example.com or by calling Customer Services on 0151 548 1554 within the specified time limit (60 Days); proof of purchase must also be supplied.
In the event that a higher-priced alternative is selected, then any difference in price must be paid at the time of re-selection. We are unable to refund any difference in price if a lower priced product is selected.
Re-delivery charges will be applied – actual pricing to be confirmed by your OCTAsmart stockist 'Comfort Exchanges' is limited to one exchange per product ordered. The cost to collect your returning mattress will be a minimum of £50; however, this amount may vary for remote postcode areas If a certain model, size or fabric is no longer available, Dormeo UK Limited reserves the right to substitute a suitable alternative.
The comfort exchange does not apply to:-
Mattresses that are defective due to misuse, wilful damage, accidental damage (including unauthorised repairs or alterations) neglect or general wear and tear.
Please note delivery of your new mattress may take up to 28 days from the order point to be delivered.
The comfort exchange applies in the United Kingdom, the Channel Islands and the Isle of Man only and is in addition to and does not affect your legal rights. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards Office.
Only the original purchaser may invoke the comfort exchange, and it only applies to mattresses that remain in the country of purchase.
These terms are governed by English law and are subject to the non-exclusive jurisdiction of the English courts.
