1. Information about us

3. How our Seller/Buyer contract is formed.
3.1 Orders are placed through the website and a confirmation email sent upon acceptance of the order
3.2 If the product ordered has been discontinued or is not available the buyer is entitled to a full refund. The seller will not be obliged to compensate the buyer due to disappointment
4.1 Delivery of your order is complete when you receive all the items in your order. Ownership of items is complete upon receipt of such items.
4.2 Delivery times quoted on the website are approximations of working days and not guaranteed. We cannot be held liable for environmental factors that may affect delivery times. We do our utmost to arrange delivery at the quickest and most convenient time for you
4.3 The buyer or nominated adult must be available to take receipt of the goods.
4.4 Delivery can be made to an alternative address from that of the buyer
4.5 We will not be liable for special delivery requests where the goods are agreed to be left in a location at the buyer’s risk.
4.6 Please check your items upon delivery, items must be in a satisfactory condition before signing for the goods.
4.7 Deliveries may sometime occur on separate days in the case of multiple products being ordered from multiple suppliers. For this we cover the cost of delivery unless specified by instruction of the buyer.
4.8 Assembly items such as flat pack furniture are to be assembled by the buyer upon receipt, unless otherwise stipulated or arranged.
4.9 Some postcodes may incur a longer delivery time than others, dependent upon location.
4.10 Items arranged on a next day service will be delivered to your door, drivers in this case are not insured to enter the property and delivery is to the doorstep unless arranged.
4.11 When delivery is scheduled with a 2 man service to the room of choice, we will not be held liable for any damage incurred in the movement of household items or measures undertaken at the request of the buyer upon delivery.
4.12 We recommend you do not dispose of your old bed until receipt of your new bed. We can not be held responsible for any changes in lifestyle caused due to ill timing.
4.13 If delivery has failed due to the buyer’s non attendance at arranged delivery address, we hold the right to charge for re-delivery of the products.
4.14 Our preferred delivery date and delivery comments cannot always be guaranteed due to external factors that may be out of our control, although we do our best to arrange the delivery for the day requested.
4.15 It is not our (Bed Factory Direct) responsibility to ensure items purchashed either online or in store fit into your property and/or rooms. It is the customer's responsibility to make sure items will fit before purchase. In such a case where the products purchased do not fit into your room or property and have been delivered, the customer will incur the cost of returning the items.
5.1 You can cancel your order anytime up to 14 working days after delivery of your goods under your statuary rights. You will be entitled to a full refund under our cancellation policy set out in clause (5.4 & 5.5)
5.2 To cancel an order you must inform us through writing (see section 14) or via email at firstname.lastname@example.org. Initial contact can be made by telephone on 0800 138 8288. The goods must be available for collection from the delivery address and areas free from obstruction upon removal. We will not accept liability for any damage incurred to personal property in the collection of goods.
5.3 If goods are to be returned, it is your statutory obligation to ensure the goods are kept in the same condition as when delivered and should be packed in the original packaging where possible. Where the original packaging is not available, the goods must be packaged in a manner suitable to protect them during transport. The buyer will be liable for any damage incurred if the packaging is not appropriate. The buyer must inform us of the Couriers name, consignment number and the date the item will delivered to the Marl Road address. The buyer must ensure their order number is quoted in all correspondence and consignment details. Failure to do so could delay any refund due.
5.4 If you wish to cancel the goods under the consumer contracts regulations (previously known as the distance selling regulations) you are entitled to a full refund. This will be awarded at the earliest opportunity but within a maximum 14 days upon receipt of the returned goods. We hold the right to deduct any collection charges associated with the cancellation of the contract under the consumer contracts regulations.
5.5 If you cancel the contract within 14 working days from delivery of your goods due to the product being faulty, you are entitled to a full refund with collection expenses covered by the seller. If the product is faulty after 14 days, we may discuss the opportunity to repair any faulty parts of your order and the convenience of this solution. Please report any faults in writing either by letter or email using our "contact us online" section of our website.
5.6 Refunds will be processed using the arrangement under which you initially placed your order.
5.7 Once a collection date has been agreed, the buyer may be liable for collection charges if the goods are not available to the courier on the agreed date, and a further date has to be arranged..
5.8 If the buyer placed the order over the telephone, in person or in store they will be exempted from 4.1. Orders for special goods such as items modified to the buyer preference upon request will also be exempt from 4.1.
5.9 Unused mattresses can be collected within 7 days, in the original, unopened packaging. An agreed collection charge will be deducted from any refund made upon receipt of the mattress by ourselves.
5.10 We do not hold liability for wear and tear, negligence, inappropriate use or destructive practises to the product. We are also not accountable for unauthorized amendments that do not appear in the manufacturers initial guidelines, without prior written consent.
6. Product Information
6.1 All representative images, specifications, drawings, brochures, advertisements and information are intended as an illustration. There may be changes beyond our control or slight manufacturing changes to finished products.
6.2 Where subtle changes to the manufacturing process has occurred, the goods supplied will be of equal or improved fit for purpose and quality.
6.3 Please be aware that colours can sometimes be distorted electronically and may differ slightly from finished products.
6.4 Goods, such as headboards, bedding and pillows etc on divan beds, presented in a illustrative setting are not included unless stipulated in the product description
6.5 Fabrics may vary from the images provided on the website but will always be of equal or better quality.
6.6 Unauthorized use and/or duplication of material without express and written permission from Bed Factory Direct and/or the owner is strictly prohibited. Excerpts, images and links may be used, provided that full and clear credit is given to Bed Factory Direct with appropriate and specific direction to the original content.
7.1 We are not obliged to complete an order where a pricing error has occurred.
7.2 If a customer has been overcharged due to pricing error, we will honour the correct lower price. In the case of underpayment by error, we will contact the buyer to resolve the issue or provide a full refund.
7.3 All prices on the site are inclusive of VAT.
7.4 Orders confirmed before intentional planned price increases or decreases will be charged the price as correct at time of order confirmation.
7.5 We are under no obligation to refund existing customers in the case of price reductions and special offers made after their order confirmation.
7.6 We have the right to refuse any order, special offer or discount code that has expired the timescale that such offer was intended.
7.7 We do not offer discount codes on any of our products when paying using the Dividebuy payments method.
8.Title & Risk
8.1 The goods are the buyer’s responsibility from the time of delivery.
9.1 Products sold here are intended for domestic use only; we have no liability for business loss incurred in commercial dealings, loss of profit or loss of potential opportunity.
9.2 Nothing in this document limits our liability for:
(a) Fraudulent use or misrepresentation
(b) Death through negligence
(c) Injury through negligence
(d) Breech of guidelines under the Sales of Goods Act 1979
(e) Defective items under the Consumer Protection Act 1987
10. Warranty & Guarantees
10.1. All products are guaranteed for a minimum of 12 months.
10.2. All goods sold comply with all applicable legislation and consumers are reminded that these items and conditions do not affect statutory rights.
10.3. Some mattresses also benefit from a free a limited warranty of up to 10 years.
10.4. In the unlikely event you do have a warranty claim, we request a photograph of the fault to forward to the manufacturers who can then authorise immediate action for the warranty claim.
10.5. There may be charges applied to warranty claims after the first 12 months - this varies dependent on the manufacturer - and any charges will be clarified before a warranty claim is processed.
10.7. Any claims made after the first 12 months are subject to transport charges.
11. Right of Cancellation
11.1. The customer has an unconditional right to cancel an order.
11.2. You must exercise the right to cancel an order by informing bedfactorydirect.co.uk in writing to our postal address or via email before the goods are dispatched.
11.3. Customers wishing to cancel their order after dispatch must ensure that reasonable care is taken of the goods and that they are returned to bedfactorydirect.co.uk (see returns address) unopened and unused in an 'as new' condition complete in its sealed original packaging and with all instructions included.
11.4. If the goods have left our premises, transport charges will be incurred. The customer is responsible for all transport costs; it is the responsibility of the customer to return the goods using their own transport to the address at the bottom of this page.
11.5. All orders are inclusive of a non refundable payment processing fee of 3.5% for credit cards and Paypal payments or £1.50 for debit cards.
11.6. To accept an item for return we must be notified in writing within 14 days of delivery. The item must be then returned to us as soon as possible.

12. Damaged / Disputed goods
12.1. We will exchange any mattress that is either damaged or faulty upon delivery only when the customer follows all of our terms and conditions that apply.
12.2. Before processing a damaged / disputed goods claim, we will require a photograph of the damaged / disputed goods before any action can be processed.
12.3. It is the responsibility of the customer to check the goods have been delivered in good condition.
12.5. If you sign for an item as delivered in good condition and you subsequently notify us of damage, this may affect your eligibility for an exchange.
12.6. Please contact our customer services team within 24 hours of delivery to notify us of a fault / damages via email to firstname.lastname@example.org.
12.7. Please send in photographic evidence of any damages as soon as possible via email email@example.com within 7 calendar days.
13.1. bedfactorydirect.co.uk will refund the purchase price of the goods or services within 14 days of receiving and checking the goods are as new and complete - less any transport costs and a payment processing fee of 3.5% for credit cards and Paypal payments or £1.50 for debit cards.
13.2. Customers who refuse delivery at the door will be liable for a return delivery charge from £35 + Vat.
13.3. Unfortunately, we cannot authorise refunds or exchanges on any products that have been unpacked or slept on.
13.4. To accept an item for return we must be notified in writing within 14 days of delivery. The item must be then returned to us as soon as possible.
13.5. bedfactorydirect.co.uk cannot be held liable for items ordered incorrectly or in the wrong size.
13.6. Refunds are not guaranteed for inadequate access or for items not fitting in the customer’s room.
13.7. Where possible, bedfactorydirect.co.uk will liaise with the manufacturer with regards to an exchange - it is the sole discretion of the manufacturer to offer an exchange if this circumstance should arise.
13.8. Exchanges, where applicable, will incur additional costs.
14. Made to measure items
These are goods that are not stock items and are made to your specific requirements, e.g. special sizes or items that are made to non standard specifications.
It is important that you are happy with the items that you are purchasing as they are non returnable and non refundable (unless they are faulty or misdescribed).
Once the items have been made and/or dispatched to you then we are unable to cancel the order and you will not be entitled to a refund (unless the product has a manufacturing fault or was misdescribed).
